X-ACTO POETRY CONTEST
CONTEST OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCE OF WINNING.
1. HOW TO ENTER: To enter the X-ACTO POETRY CONTEST ("Contest"), a teacher of any grade from K–8, in the schools/territory set forth below in the Eligibility section, shall enter, via printed entry form from the microsite landing page (www.scholastic.com/instructorpoetrycontest), or the printed form from the March/April issue of Instructor magazine, via U.S. mail, a poem by their student(s). Along with the mailed submission, the Submitting Teachers (as defined below) must include his/her student's name, age, grade, and teacher's own contact information: his/her name, grade taught, school city, email address, school name, and school state. All personal information collected by Scholastic Inc. ("Scholastic" or "Sponsor") from entrants and/or the Submitting Teachers will be retained by Scholastic in accordance with Scholastic's records retention policies for the Contest. Any such personal information collected by Scholastic via online entry will also be subject to Scholastic's Privacy Policy
The Contest begins April 1, 2012, 12:00 a.m. EST and ends April 30, 2012, 11:59 p.m. EDT. Eligible teachers (defined below) can submit one (1) entry per student in his/her classroom. Entry must be the student's own original work, and cannot contain previously published and/or copyrighted material in any part by any third party. Additionally, each entry may not be offensive or inappropriate, as determined by Scholastic and X-ACTO in their sole discretion. Furthermore, an entry may not defame or invade publicity rights or the privacy rights of any person, living or deceased, or otherwise infringe upon any person's personal or property rights or any other third-party rights. Scholastic reserves the right to disqualify any entry it deems to be offensive, or inappropriate. Scholastic reserves the right to not award all prizes if, in its sole discretion, it does not receive a sufficient number of qualified and eligible entries.
2. ELIGIBILITY. Sweepstakes is open only to students who are legal residents of the 50 United States (including the District of Columbia) or Puerto Rico, and who are currently enrolled in grades K–8 in a public school, accredited private school, or a home school in compliance with the laws of the state where the home school is located. U.S. teachers who are legal residents of the 50 United States (including the District of Columbia) or Puerto Rico, 18 years of age or older, and who currently hold a teaching position in grades K–8 in a public school, accredited private school, or who teach grades K–8 in a home school in compliance with the laws of the state where the home school is located (the "Submitting Teachers") are the only persons eligible to submit the entries on behalf of the entrants. Void where prohibited by law. Full- or part-time employees of Sponsor, X-ACTO, their respective parents, affiliates, subsidiaries, advertising, promotion and production agencies, and their immediate families and those living in their households are not eligible to enter. Any person who attempts to defraud or in any way tamper with this Contest will be ineligible for prizes. Void where prohibited or restricted by law.
3. WINNERS. One (1) Grand Prize student winner (the "Grand Prize Winner") and two (2) Runners-Up student winners (the "Runners-Up," collectively with the Grand Prize Winner, the "Winners") from two grade levels (K–3, 4–8) will be selected by Scholastic from among all eligible entries on or about May 15, 2012, and notified by phone or email on or about May 25, 2012. There will be two Grand Prize Winners and four Runners-Up in total. The winning entries will be chosen based on the following equally weighted judging criteria: (a) creativity and (b) quality of their submission. The K–3 Grand Prize winner (the "Winner") will receive fifteen (15) books on writing/poetry; and the 4–8 winner (the "Winner") will receive The Hunger Games trilogy boxed set. The approximate retail value ("ARV") of each Grand Prize is $50. Each of the two Runners-Up will receive five (5) books on writing/poetry. The ARV of the Runners-Up prizes is $25.
The Submitting Teachers who submitted the Grand Prize Winners' entries will each receive two (2) TeacherProTM Pencil Sharpeners and five (5) Scholastic books relevant to their grade level. The Submitting Teachers who submitted the Runners-Ups' entries will each receive a TeacherProTM Pencil Sharpener. The ARV of the Teacher prizes is $580.The above teachers are collectively the "Teacher Winners."
Prizes are non-transferable, non-assignable and no cash alternative will be offered except by Scholastic and X-ACTO in the event of unavailability, in which case a prize of equal or greater value will be awarded. The decisions of the judges are final and binding. If any prize or prize notification is returned as undeliverable, the potential winner chooses to decline a prize for any reason, or the potential winner or the Submitting Teacher fails to comply with these Official Rules and all the requirements set forth herein, the prize may be forfeited. Taxes on prizes, if any, are the sole responsibility of the Winners and Teacher Winners, respectively.
4. GENERAL. By submitting an entry, each Entrant and Submitting Teacher agree Scholastic shall own the entry submitted (including all rights embodied therein in winning entries) and that it and its designees may exploit, edit, publish, use, adapt, modify, or dispose of any entry and elements embodied therein, online, in print, film, television, or in any other media now or hereafter known for advertising, promotional, or other purposes throughout the world, in perpetuity, without additional compensation or notification to, or permission of the Entrant, except as prohibited by law. Further, by entering, Entrants and the Submitting Teachers agree to abide by these Official Rules, warrant and represent that their entries are their original work, and grant to Scholastic and its designees the right to use their names, entry, biographical information provided and likeness in any media now or hereafter known for advertising, promotion, and/or other purposes throughout the world without additional compensation or notification to, or permission of the Entrant, except as prohibited by law. Additionally, the Submitting Teachers represent and warrant that they have form releases and/or other documentation on file that allow them to grant the rights to Scholastic and its designees set forth herein, and that the Entrants, Winners, and Teacher Winners cannot assert any ownership rights in or to an entry. The Winners and their parents/legal guardians, and the Teacher Winners, may be required to sign and return an affidavit of eligibility and liability/publicity release within ten (10) business days of notification attempt or an alternative Winner may be selected. By entering (except where prohibited by state law) and/or accepting a prize, all Entrants and the Submitting Teachers agree to release Scholastic, X-ACTO, their subsidiaries, affiliates, directors, officers, and employees and their advertising, promotion, or production agencies (collectively, the "Released Parties") from any and all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the receipt, ownership, or use of the prize or participation in the Contest, including use of an entry. Subject to all applicable laws.
If Scholastic and/or X-ACTO discover at any time, during, or after the Contest, that an entry contained infringing material, the Winner or Runner-Up that submitted the entry will be immediately disqualified and that Teacher Winner will be obligated to immediately return any and all prizes which may have been awarded to them in connection with that entry.
The Released Parties are not responsible for late, lost, stolen, inaccurate, garbled, damaged, illegible, undelivered, delayed, misdirected, or postage-due entries or mail; interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections; for lack of availability or accessibility, or miscommunications due to failed computer, satellite, telephone, or cable transmissions or lines; for technical failure or jumbled, scrambled, delayed, or misdirected transmissions; for computer hardware or software malfunctions, failures, or difficulties; or for any other computer, network, technical, typographical, human or other error, problem, or malfunction related to or in connection with the Contest and printed product.
5. WINNERS LIST. The names of the Winners, Runners-Up, and Teacher Winners will be available after on or about May 31, 2012, online at www.scholastic.com/instructorpoetrycontest. You may request this name by sending a self-addressed, stamped envelope by July 31, 2012 to: X-ACTO Poetry Contest Winners List, Scholastic Inc., 557 Broadway, 5th Floor, NY, NY 10012.
